Licence Agreement between the Modern Humanities Research Association and users of the electronic versions of its journals

The Modern Humanities Research Association (hereafter MHRA) will license the electronic access of its journals on the terms and conditions set out in this Agreement. The rights granted under this Agreement apply only to those journals for which the Licensee has a current paid subscription, or to those documents that the Licensee has paid for by credit card.

  1. Copyright

    (a) All copyright in the journals and the documents contained in the journals is owned by MHRA and/or its respective licensors. All rights not expressly granted in this Agreement are reserved to the copyright owners.

    (b) Subject to the Copyright, Designs and Patents Act 1988, the use of material supplied by the MHRA is limited to viewing, downloading, temporary storage and printing a single copy of the individual document by Authorized Users for personal use only.

  2. Access

    Online access is currently available:

    (a) to subscribers as a free adjunct to the print subscription to the same title.

    (b) to non-subscribers on payment of a fee to the MHRA through ingenta's "Pay-per-View" service.

    Rights granted under this Agreement cannot be transferred, sold or rented to another party.

    Where the Licensee is a non-subscriber accessing documents through ingenta's "Pay-per-View" service, that individual is an Authorized User once credit card payment has been accepted.

    Where the Licensee is a single academic institution with a current paid subscription to the journal(s) concerned, the Authorized Users are current members of the staff of the Licensee (whether on a permanent, temporary, contract or visiting basis) and individuals who are currently studying at the Licensee's institution, who are permitted to access the institution's secure network from within the library premises or from such other places where Authorized Users work or study (including but not limited to Authorized Users' offices and homes, halls of residence and student dormitories) and who have been issued by the Licensee with a password or other authentication, together with other persons who are permitted to use the Licensee's library or information service and access the secure network but only from computer terminals within the library premises.

    N.B. Access is granted to individuals and to single academic institutions only. Public libraries and academic consortia are specifically excluded from this Agreement.

  3. Licensee's responsibilities

    The Licensee is responsible for all charges associated with accessing the journal such as computer equipment and internet access.

  4. Liability

    (a) The MHRA has taken reasonable care to ensure that data in the journals available through this service are error free and up to date. However, the MHRA accepts no responsibility for corruption to the data including, but not limited to, any defects caused by the transmission of the data.

    (b) The MHRA is using a third-party service to provide electronic access to the journals. The MHRA accepts no responsibility for any defect, failure in or non-availability of the service.

  5. Termination

    (a) The MHRA may terminate or suspend electronic access for breach of this licence by the institution or any user.

    (b) The MHRA may terminate electronic access if its agreement with the third-party service terminates for any reason. However, the MHRA will use reasonable endeavours to find an alternative third-party service.

  6. Acceptance

In downloading this document, I agree to abide by the terms of the Agreement. MHRA reserves the right to vary this Agreement from time to time. Such changes shall be posted on this web page. Changes made in this manner shall be deemed to have been accepted by users who download, store or print any document after a period of 14 days following the day the changes have been posted on this web page.
